1. Seller
These general terms and conditions of sale (T&Cs) apply to all sales made on www.levimensa.com by Romain Bisseret, sole trader (EI), trading as LeviMensa, 26 rue du Commandant René Mouchotte, 75014 Paris, France, SIRET 992 286 369 00010, hereinafter “LeviMensa” or “the Seller”. Contact: contact@levimensa.com.
2. Scope
These T&Cs apply to any individual or legal entity buying on the site (hereinafter “the Buyer”), whether acting as a consumer or as a professional. They cover:
- physical products (the book);
- digital products (templates, guides and downloadable content);
- open training sessions in a virtual classroom;
- Supercycles days;
- access to the LeviMensa Circle;
- coaching sessions.
Placing an order constitutes unreserved acceptance of the T&Cs in force on the date of the order. In-house training and any tailored service are subject to a written proposal, which prevails over these T&Cs.
3. Orders
The Buyer selects products or session places, adds them to the cart, checks the summary (price, any shipping costs), accepts the T&Cs and then pays. The order is final upon receipt of the confirmation email sent after payment. Data recorded by LeviMensa serves as proof of transactions.
Training places are offered subject to availability. If a session is full at the time of ordering, LeviMensa offers the Buyer the next session; the Buyer then has 7 days to cancel the order and be refunded.
4. Prices
Prices are shown in euros, with no tax added: VAT not applicable, article 293 B of the French General Tax Code. Shipping costs for the book are shown before the order is confirmed. The price applicable is the one displayed at the time of ordering. Early-bird prices, group prices and discount codes apply under the conditions shown on the site.
5. Payment
Payment is due in full when ordering, by bank card, via the secure Stripe platform. LeviMensa never has access to your card details. An invoice is sent by email after payment.
6. Book delivery and access to digital content
The book is shipped to the address given when ordering, within an indicative 15 days. If the book has not been delivered within 30 days of the order, the Buyer may request in writing the cancellation of the order and a full refund. The Buyer checks the parcel on receipt and reports any problem within 7 days.
Digital products are available via a download or access link as soon as payment is confirmed.
7. Training, Supercycles and coaching
The dates, times, format (virtual classroom or in person) and programme of each session are specified on the training page. Login or access details are sent before the session.
Substitution
A participant who cannot attend may be replaced by another person free of charge up to 10 working days before the session.
Postponement or cancellation by the Buyer
Once the withdrawal period has expired:
- at least 30 working days before the session: postponement or refund free of charge;
- between 30 and 15 working days before the session: 30% of the price remains due;
- less than 15 working days before the session: 70% of the price remains due.
A transfer to a later session is always offered before any charge is retained.
Cancellation by LeviMensa
If there are not enough participants, LeviMensa may postpone the session no later than one week before the scheduled date. The Buyer then chooses between the next session and a full refund.
Accessibility
Anyone with a disability is invited to let the disability contact know their needs, ideally one week before the session, so that the necessary adjustments can be considered (see the Accessibility and disability).
8. The LeviMensa Circle
The Circumference is a monthly subscription, automatically renewed each month. Subscribers can stop it at any time from their account or by email to contact@levimensa.com ; cancellation takes effect at the end of the month already paid, with no further charge.
The Centre is open by application. It is paid in a single instalment for a three-month period and is not renewed automatically.
The three months of access to the Circumference included with the LeviMensa training are not renewed automatically.
9. Right of withdrawal
Consumer Buyers have 14 days to withdraw without giving any reason (article L. 221-18 of the French Consumer Code):
- for the book, from receipt; return costs are borne by the Buyer;
- for training, Supercycles, coaching and the Circle, from the date of the order.
To withdraw, the Buyer sends a clear statement by email. LeviMensa refunds within 14 days of the withdrawal (for the book, after receiving the return), using the original payment method.
Exceptions (article L. 221-28): the right of withdrawal does not apply to digital content not supplied on a physical medium whose performance has begun with the Buyer's express consent, the Buyer thereby waiving the right of withdrawal. When the Buyer asks for a service to begin before the end of the withdrawal period, they remain liable for the price of the part already performed.
10. Warranties
The book is covered by the legal guarantee of conformity (articles L. 217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code). Digital products are covered by the legal guarantee of conformity applicable to digital content.
11. Intellectual property
The LeviMensa method, training materials, templates, videos and content provided or made accessible remain the exclusive property of Romain Bisseret. The Buyer is granted a personal, non-transferable and non-exclusive right of use, and undertakes not to reproduce or distribute them, or use them to train other people, without prior written consent.
12. Liability and force majeure
LeviMensa has an obligation of means. It cannot be held liable for indirect damage or for any incident related to the internet or the Buyer's equipment. Neither party is liable for failure to perform due to force majeure within the meaning of article 1218 of the French Civil Code.
13. Personal data
Data collected when ordering is used to process the order, for invoicing and to manage the customer relationship. Its processing is described in the Privacy policy.
14. Complaints and mediation
Any complaint can be sent by email to contact@levimensa.com or by post to the Seller's address. LeviMensa acknowledges it within 48 working hours and provides an answer within 7 days.
If a dispute remains unresolved, consumer Buyers may use the consumer mediator free of charge: [TO BE COMPLETED: mediator's name, website and address]. They may also use the European online dispute resolution platform.
15. Governing law
These T&Cs are written in French and governed by French law. In the event of a dispute with a professional, the courts of Paris have jurisdiction. Consumers may bring proceedings before the court of their place of residence or of the place of delivery.
